To serve: Federal investigation prompts review of hundreds of criminal cases

“The federal probe into the Iberia Parish Sheriff’s Office could reopen hundreds of criminal cases and already has led to the dismissal of one narcotics case, according to the Iberia Parish District Attorney’s Office.

Sheriff Louis Ackal and Lt. Col. Gerald Savoy were indicted last week on conspiracy against rights and depravation of rights charges. Eight former deputies — five narcotics officers, two jail supervisors and a K-9 officer — pleaded guilty over the last few weeks to similar civil rights violations.

The DA mailed 170 letters earlier this month notifying criminal defense attorneys who’ve handled cases involving the first six deputies who pleaded guilty. Hundreds more letters are expected to be mailed addressing the remaining guilty pleas and Ackal and Savoy’s indictments.

The DA’s office has identified all of the attorneys who represented defendants since Ackal took office in 2008, said Iberia Parish District Attorney Bo Duhe.

Duhe says the letters are being mailed “out of an abundance of caution.” It will be up to the defense attorneys to file motions in their cases, but the DA’s office is also reviewing all opened and closed narcotics cases.

“You’re talking about a substantial number of cases that are going to be negatively impacted,” First Assistant District Attorney Rob Vines said. “We’re also going back and looking at closed cases to look at how this information may have impacted our charging decisions and the sanctity of the convictions.”

Duhe expects the letters will mostly affect defendants who went to trial and one of the officers testified against them, or entered a “best interest” plea, perhaps because they thought a jury would convict them because of an officer’s testimony.

“Particularly those officers who admitted they were untruthful in giving their testimony in civil cases, all their testimony are seriously in doubt,” Duhe said.”

Makes you wonder how many innocent people are in jail

When they sent my wife away it was a circus

She was charged with resisting obstructing and all the report said was ” She refused my search of the vehicle”

That was what was written on Stacey and Tracey’s also

The only problem?

It was Stacey’s vehicle, so My wife or Tracey could not give consent to search it

One year after charging them the charge and arresting officer were changed

It was a fish and wildlife charge initially and a second degree misdemeanor

They changed it to a State of Florida charge and made it a first degree misdemeanor

Up to 1 year in jail instead of 30 day Max.

Then the new charging officer changed his testimony that he had given earlier

He now said that all 3 of them refused to exit the vehicle for 3 minutes when ordered to do so

Even though the transcript of his earlier testimony said that they exited without hesitation

Our attorney never brought it up

Guilty

Now it gets better

At sentencing the cop Emmanual Tsongranis asks to give a victims impact statement

The judge says no because he is not the victim, the state of Florida is

So the cop says that he has something really important to read

The judge looks at the paper he is waving and finally says “Okay, there was  a report that she tried to hit you, I’ll allow it”

(And that was total and utter bullshit because she was in handcuffs the entire 3 hours and no mention whatsoever of attempted violence”

So the judge takes it and reads it and guess what it is?

“A Broward man who was fired from his job as a Pasco County Sheriff’s deputy was sentenced Monday to five years in federal prison for receiving child pornography.

Matthew Bondi, 22, of Deerfield Beach, was arrested in August in Davie when authorities said he tried to meet an underage teenage boy for sex.

Bondi pleaded guilty to a lesser charge of receiving a video 15-year-old masturbating.

“I sincerely apologize,” Bondi told the judge Monday. “I understand what I did and I have from day one.”

Bondi was just eight months into what he hoped would be lifetime career in law enforcement when he was arrested. He said he has already begun to try to make “a complete and utter difference in my life.”

“A city police officer was arrested Friday for unlawfully discharging his gun while off-duty, the prosecutor’s office said.

Dante Gordon, 25, of Paterson, was charged in relation to an officer-involved shooting that occurred last week at 7-Eleven, which he did not report until the following morning, according to Cinda Adams from the Passaic County Prosecutor’s Office.

Gordon, a Paterson cop, was outside the 7-Eleven on Main Street at around 1:20 a.m. on Feb. 25, when he pointed his gun at a 34-year-old Wanaque resident.

He then fired the weapon. Fragments from the discharge injured a 36-year-old Paterson resident, said Adams.

The prosecutor’s office did not disclose what led Gordon to pulling out his gun. They also did not give information on why it took more than a week for Gordon to be arrested.

The Paterson Police Department did not know of the incident until the next morning, when Gordon reported it hours later.

At 10 a.m., the Passaic County Prosecutor’s Office Shooting Response Team was sent to the scene due to the discharge of a firearm by a police officer.

The prosecutor’s office previously acknowledged the police-involved shooting, but with few details.

Gordon was charged Friday with second-degree possession of a weapon for an unlawful purpose, fourth-degree aggravated assault by pointing a handgun at or in the direction of another and two counts of fourth-degree aggravated assault by recklessly causing bodily injury to another with a deadly weapon.”

AG Lynch Testifies: Justice Dept. Has ‘Discussed’ Civil Legal Action Against Climate Change Deniers

“Attorney General Loretta Lynch testified Wednesday that the Justice Department has “discussed” taking civil legal action against the fossil fuel industry for “denying” the “threat of carbon emissions” when it comes to climate change

During Lynch’s testimony at a Senate Judiciary Committee hearing, Sen. Sheldon Whitehouse (D-R.I.) said that he believes there are similarities between the tobacco industry denying scientific studies showing the dangers of using tobacco and companies within the fossil fuel industry denying studies allegedly showing the threat of carbon emissions.

He went on to point out that under President Bill Clinton, the Justice Department brought and won a civil case against the tobacco industry, while the Obama administration has “done nothing” so far with regard to the fossil fuel industry”

Oregon Fire Chief Catches FBI Agents Posing as Militia – Quits His Job in Protest

“This week, Harney County Fire Marshall Chris Briels resigned after discovering undercover FBI agents posing as militia members near the Malheur National Wildlife Refuge, which has been the site of a standoff for weeks now. According to Briels, he found FBI agents who were impersonating militia members lurking around the town’s armory. When he inquired about the undercover operation with county Judge Steve Grasty he was told to back off.

Just before this discovery was made, there were reports of people who looked like militia harassing locals, which is uncharacteristic of the protesters who initially assembled at the refuge. It turns out that these militia members suspected of harassing locals were actually undercover FBI agents.

During an impromtu press conference, Briels explained how he was so disrespected in his encounter with Grasty and was so disgusted with the situation in general, that he no longer wants to work for a government that he does not believe in. Briels added that he would still be helping people in the community with fire prevention and other issues that he has helped with in the past, but he will just no longer be doing it as a government employee. Briels went on to describe how he exposed undercover FBI agents who had come to town and were creating problems amongst the locals.

When announcing his resignation, Briels described his encounter with the judge.

“I’ve been told by Steve to distance myself from this committee of public safety. I’ve been told that we don’t know what we’re doing. I’ve been told that my life is in danger. I’ve been told all kinds of things. I will not be told what to do. I have my own mind, and I will use my own mind, not somebody else’s,” Briels said.

Many activists and militia members are now suspecting that the undercover agents were planning to act as agent provocateurs and create trouble in order to frame the protesters for things that they did not do. This theory is supported by the fact these undercover agents were reportedly bothering locals and acting in a threatening manner.

However, mainstream media has reported that militia members were harassing locals, but now that version of events is being brought into question considering the fact that undercover agents were posing as militia. The looming threat of agent provocateurs may be one of the reasons why the refuge occupiers are turning away help from outside militias who have attempted to join the occupation.

As the situation at the refuge becomes increasingly volatile, leaders of the occupation have announced that they will soon be making plans to disperse, but they have not yet said when this will happen. Meanwhile, the FBI has said that they will be filing federal charges against the militia members that they have found evidence on throughout the occupation.”

Longest armed stand off in history ends after 15 Yrs.

“While a bunch of aggrieved men in camo gear continue to sulk in a bird sanctuary in Oregon, the longest-running standoff in American history has quietly come to an end in Texas. John Joe Gray has been holed up on his ranch for 15 years after assaulting a state trooper and then refusing to return to court. Someone finally notified Gray that the charges against him were dismissed more than a year ago.

As WFAA reports, Gray was arrested in 1999 for biting a state trooper during a traffic stop and getting into a “scuffle” with him. He was charged with assaulting a public servant, and, rather than make his court date, he barricaded himself at his ranch in Henderson County, near the town of Trinidad, and threatened to kill any sheriff’s deputies who might come to fetch him. From WFAA:

“If they come out after us, bring extra body bags. Those who live by the sword will die by the sword,” Gray told ABC News in a 2000 interview.

Since the felony charge in 1999, Gray has never left his 47-acres along the banks of the Trinity River between Tool and Trinidad, Texas.

Instead, Gray, his children, grandchildren, and friends patrol their property with pistols and rifles and refuse to let strangers inside.

National Geographic said it took a crew two years to earn the family’s trust recently.

“We’ve never shot no one yet,” Gray told Nat Geo. “But they know, if they come on us, they’ll be surprised what’s going to happen to them.”

The family hung a number of signs on their fences: “Disobedience to tyranny is obedience to God!”

From the Cato institute, Worst police misconduct for December: Accident victim shot and paralyzed by cop dies in hospital

“So for December we have selected the shooting death of Andrew Thomas in Paradise, California.  According to news reports, here’s what happened:  Thomas was seen leaving the parking lot of a bar and his vehicle didn’t have its lights on — even though it was late at night.  Officer Patrick Feaster suspected the driver might be intoxicated and so pursued Thomas to pull him over and investigate further.

No problem so far.  We want police to be alert for impaired drivers who endanger other people.

Next, Thomas did not pull over after Feaster was behind him with his police lights flashing.

Moments later, Thomas’s SUV crashed and his wife was ejected from the vehicle.  She died.

Next, things get even worse.  Officer Feaster is seen on dash-cam video walking toward the crashed SUV.  The video shows Thomas trying to climb out of the overturned SUV.  Feaster draws his sidearm and shoots Thomas in the neck and he falls back into his SUV.

After the shooting, Officer Feaster gets on his radio to report that the driver is refusing his commands to get out of the vehicle.  He does not mention that he shot the driver.  Feaster also reports that a injured woman is unresponsive, but the video shows that he is not checking on her condition or rendering aid.

Other police and responders get to the scene, but ten minutes go by before Feaster says he fired his weapon.  It is very unclear what could be the justification for shooting a man after a vehicle crash in these circumstances.  Officer Feaster says he was not threatened, but that his gun went off accidentally.

On a police body camera, Feaster is heard telling the watch commander that his gun went off, but he didn’t think the driver was hit because he wasn’t aiming his weapon in the driver’s direction.  Thomas initially survived the shot to his neck, but was paralyzed.  He died weeks later.

Despite community outrage, the local prosecutor, Mike Ramsey, declined to file any criminal charges against Officer Feaster because he said he lacked sufficient evidence to prove a crime in court.  That’s very odd.  Prosecutors would typically be relieved to know that the incident was captured on videotape.”

Bundy redux: A different take on the Malheur stand off

“I have been observing events with the Hammond case and the occupation of the wildlife complex in Malheur. I wasn’t going to comment, but due to what I have seen on the internet from persons/organizations that are considered authoritative online commentators, and the general wailing and gnashing of teeth, I am drawn to comment. What I am going to say goes against the grain of what appears to the established GroupThink that has grown up as a response to this situation. I am going to make a number of points that originate from my thoughts on this matter. I don’t necessarily have a strong opinion about the events at Malheur, I don’t know any of the people there, and I have no inside knowledge. I am simply an observer.

– I see a huge amount of negative commentary from the online Patriot community, from a number of influential sources. I see a lot of armchair quarterbacking. Apparently the protesters at Malheur are not the ‘chosen ones.’

– There is a lot of negativity coming from what appear to be militia groups in the area. We have already covered a lot about these groups and their made up rank structures – why are they suddenly the authority? Some of the statements made are laughable, for example citing the need for the Governor to activate them to actually do anything. Does the Governor actually recognize these militias? What is this fantasy? What gives them the authority to say the Malheur protesters have no business protesting?

– This smug groupthink from the Patriot community seems to be led by fear of the left’s reaction. Apparently this is not the time to protest tyrannical actions by Leviathan, because the left might be upset? Really? When is the left ever not going to be upset by the actions of the forces of freedom?”

“The situation with the Hammonds is one of clear tyranny. I would put it like this: the story of the West is not the same story as the Eastern original colonies, with all the quaint forgotten stuff about the Founders and the Boston Tea Party and the Constitution. It has never been about that. It is bad big guy against good little guy. It is every western movie you ever watched. It is the BLM (insert: railroad, rich bad guy rancher etc) against the little guy, pushing them off the land. We all want to live in peace in the former United States, without the threat of violence and tyranny. As freedom diminishes, as Leviathan rises, it will be our turn at some point. Malheur is a peaceful protest, so far, unless they are attacked. What if you are forced to use arms to defend yourself against tyranny? Can you see the online patriots running for the hills, reinforcing the rhetoric of the left as you are painted as a nut-job with ‘an arsenal.’”

“In the meantime, I am grateful to Bundy and his group standing up and drawing attention to the actions of the tyrannous BLM. I hope no harm comes to them, and they are able to return peacefully to their families.

In the case of 12 Yr. old Tamir Rice the grand jury decided not to charge the cops who shot him while he had an airsoft pistol in his waistband

Fine, mistakes happen, but it doesn’t change the fact that it was in fact a mistake and never should have happened in the first place

But my real problem was that they never gave the kid first aid

They handcuffed his younger sister and put her in the squad car while they watched the kid bleed out

Four minutes later two more cops showed up and immediately administered first aid

Congress Provides $1.6B to Resettle Illegal Immigrants Arriving at Border Through 2018

“A massive appropriations bill expected to be approved by Congress would provide more than $1.6 billion to resettle illegal immigrants arriving at the U.S. border through 2018.

Congress would award the massive check to the government just as the U.S. is experiencing a surge in arrivals of immigrant children at the southern border. Last week, federal agencies said they were opening two temporary shelters with 1,000 beds in South Texas to cope with the surge. A 400-bed shelter is also to be opened in Southern California.

“Out of an abundance of caution, the Office of Refugee Resettlement at the Department of Health and Human Services has begun a process to expand its temporary capacity to house unaccompanied children,” the Department of Health and Human Services said in a statement last Monday.

The so-called omnibus spending bill would give $1,645,201,000 through fiscal year 2018 “for necessary expenses for refugee and entrant assistance activities authorized by section 414 of the Immigration and Nationality Act and section 501 of the Refugee Education Assistance Act of 1980, and for carrying out section 462 of the Homeland Security Act of 2002, section 235 of the William Wilberforce Trafficking Victims Protection Reauthorization Act of 2008, the Trafficking Victims Protection Act of 2000 (‘‘TVPA’’), section 203 of the Trafficking Victims Protection Reauthorization Act of 2005, and the Torture Victims Relief Act of 1998,” according to its text released Tuesday.”

Former Trooper Pleads Guilty To Stealing From Fatal Crash Scene

“BRIDGEPORT — A former state trooper accused of stealing cash and a gold chain from the victim of a fatal motorcycle crash pleaded guilty on Wednesday to third-degree larceny and tampering with evidence, according to the court clerk’s office.

Aaron Huntsman, 43, was the lead investigator of the Sept. 22, 2012, crash in Fairfield that killed John Scalesse, 49, of Orange. After the crash, Scalesse’s family members told police that they couldn’t account for some jewelry, clothing and cash. They later found the clothing at the hospital, but the other items were missing.

Huntsman took a gold chain, valued at $5,500, and $3,700 in cash from the scene, saying he would put the items into evidence, according to an arrest warrant.

When questioned by his supervisor, Huntsman admitted to having the chain but denied any knowledge of the missing money, the warrant says. Huntsman said he left the chain in the cup holder in his police car, inside a glove, and had forgotten about it, the warrant says.

State police later found $3,700 in cash, wrapped in a rubber band, under the front passenger seat of Huntsman’s car, the warrant says.

Huntsman, at the time an 18-year veteran of the state police, was arrested in November 2012 and charged with two counts of third-degree larceny, interfering with an officer and tampering with physical evidence.

Scalesse’s mother Marguerite recounted when she saw her son later that night.

“I leaned over and kissed my son’s still handsome face. I petted his beautiful hair. I told him how much I loved him and how proud I was to be his mother not knowing at this time that my son’s belongings were stashed under the passenger seat of Huntsman’s cruiser,” said Marguerite Scalesse in court.”
